Terms & Conditions
These terms and conditions ("Agreement") govern your use of the QTIME Pro, hopp & QTIME mobile applications ("App") and the services provided by QTIME ("we," "us," or "our"). By accessing or using the App, you agree to be bound by this Agreement. If you do not agree with any part of this Agreement, please do not use the App.
1. Account Creation and Usage
1.1. You must be at least 18 years old to create an account and use the App. By creating an account, you represent and warrant that you are of legal age.
1.2. You are responsible for maintaining the confidentiality of your account login information. You agree to notify us immediately of any unauthorised use or suspected breach of security.
1.3. You are solely responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to comply with this provision.
2. App Usage and Restrictions
2.1. The App is provided for personal and non-commercial use only. You agree not to use the App for any illegal or unauthorised purpose.
2.2. You agree not to copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
2.3. You shall not use the App in any way that may interfere with its normal operation or compromise its security.
2.4. We reserve the right to suspend or terminate your access to the App at any time for any reason, without prior notice.
3. Intellectual Property
3.1. The App and its content, including but not limited to text, graphics, images, logos, and software, are protected by copyright, trademark, and other intellectual property laws.
3.2. You acknowledge and agree that all intellectual property rights in the App and its content are owned by or licensed to QTIME Pro. You shall not acquire any rights, title, or interest in or to the App or its content, except as expressly stated in this Agreement.
4. Privacy
4.1. We respect your privacy and are committed to protecting your personal information. Please refer to our Privacy Policy for information on how we collect, use, and disclose your personal data.
5. Limitation of Liability
5.1. To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use or inability to use the App, even if we have been advised of the possibility of such damages.
6. Indemnification
6.1. You agree to indemnify, defend, and hold harmless QTIME and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App or any violation of this Agreement.
7. Modifications
7.1. We reserve the right to modify or amend this Agreement at any time. Any changes will be effective upon posting the updated Agreement on the App. Your continued use of the App after any such changes shall constitute your acceptance of the modified Agreement.
8. Governing Law
8.1. This Agreement shall be governed by and construed in accordance with the laws of Australia. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Australia.
9. Severability
9.1. If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.
10. Entire Agreement
10.1. This Agreement constitutes the entire agreement between you and QTIME Pro regarding the subject matter hereof and supersedes all prior or contemporaneous agreements, understandings, or representations.
By using the QTIME Pro, hopp & QTIME App, you acknowledge that you have read, understood, and agree to be bound by this Terms & Conditions Agreement.
